Brumby Pay App Terms & Conditions
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “the user”) and Brumby Finance Pty Ltd (“Brumby Pay”, “we”, “our”, or “us”), the operator of the Brumby Pay App (“the App”).
By using this App, you agree to be bound by these Terms, our Privacy Policy, and any additional terms or notices presented to you. If you do not agree, do not use the App.
PART 1 - General Terms of Use
1. Purpose of the App
The Brumby Pay App allows users to:

Pay eligible invoices using a biller code and reference number

Participate in Brumby Pay’s milestone-based rewards program (optional)

View App-related information and submit contact or data privacy requests
This App is intended for payers only. Creditors are managed separately via Brumby Paypay.com.au.
2. Eligibility to Use the App
You may only use this App if:

You are at least 18 years old or have legal authority from the bill payer

You are not a resident of a sanctioned country or listed on any sanctions register
-
You have the legal right to enter into these Terms

Your usage complies with all applicable laws in your jurisdiction
We reserve the right to suspend or terminate your access without notice if any eligibility condition is breached.
3. No Account Required
This App is fully accessible without creating a user account. When paying a bill or invoice, an email address and/or phone number to receive a receipt or be notified in the event your payment qualifies for a reward is required however, this is not part of an account sign-up process and nor will those details be used for any other purposes than payment receipt or rewards messaging. Any data you provide is subject to our Privacy Policy.
4. Changes to These Terms
We may revise these Terms at any time. If the changes are material, we will notify you via the App or email (if provided). Continued use after any change constitutes acceptance of the new Terms.
5. Communications
By providing an email address, you consent to receive:

Receipts or confirmations

Reward eligibility notifications

Optional promotional messages (opt-out available at any time)
6. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia, and subject to the exclusive jurisdiction of the courts of Victoria, Australia.
PART 2 - Payments, Rewards, and System Usage
7. Invoice Payments
When a valid biller code and reference number is submitted:

We retrieve invoice details via a secure API with Brumby Pay

You are prompted to complete payment using a supported method

No fees are added by Brumby Pay; however, payment method providers may charge fees
-
You are responsible for verifying invoice details before confirming payment.
8. Rewards Program
Brumby Pay operates a fixed, deterministic reward system.

Rewards are only issued to users whose payments coincide with publicly defined system-wide milestones (e.g. every 1,00th invoice)

Rewards are non-transferable, non-exchangeable, and not guaranteed
-
Reward eligibility is determined post-payment, without inducement or precondition
-
Brumby Pay never offers chance-based or promotional incentives to influence behaviour
Important: The legal obligation to pay your invoice is independent of any potential reward.
9. Data Collection
We collect and process limited data for payment and reward tracking, including:

Biller codes, invoice numbers, and payment value
-
Device and usage data (non-identifying)

Optional email addresses
All data is handled under the Privacy Act 1988 (Cth) and in line with our published Privacy Policy.
10. Your Responsibilities
You agree to:

Provide accurate and lawful payment details

Use the App only for legitimate transactions

Not tamper with, reverse-engineer, or attempt to game the reward system
-
Not impersonate others or submit fictitious invoices
Violations may result in exclusion from the reward program or legal action.
11. Third-Party Services
Brumby Pay relies on our Australian AFSL licensed partner, Monoova to process payments.

We do not store or process payment card information

Brumby Pay is not liable for errors, delays, or failures originating from these providers
-
Use of third-party platforms is at your own risk and subject to their respective terms
12. Suspension and Termination
We reserve the right to suspend or terminate access without notice in the event of:

Breach of these Terms

Abuse of the App or reward system
-
Fraudulent or unlawful activity
-
System misuse or attempt to interfere with platform integrity
13. Limitation of Liability
To the maximum extent permitted by law, Brumby Pay Finance Pty Ltd is not liable for:

Losses arising from inaccurate invoice details
-
System downtime or App unavailability
-
Delayed or failed payments
-
Non-receipt of a reward
-
Indirect, incidental, special, or consequential damages
Use of this App is at your own risk.
14. Indemnity
You agree to indemnify and hold Brumby Pay harmless from any loss, liability, claim, or expense (including legal fees) arising out of your:

Breach of these Terms

Misuse of the App or rewards system
-
Unauthorised or unlawful activity using the App
PART 3 - Legal, IP, and Technical Provisions
15. Intellectual Property
Brumby Pay retains all rights in the App, its content, structure, reward logic, branding, and materials.

You must not copy, reverse-engineer, distribute, or exploit the App or related IP
-
Monoova and other third-party logos and systems are protected under separate agreements and may not be used without permission
16. AI-Generated Features (if applicable)
If any future Brumby Pay feature incorporates AI-based tools:

Outputs are for informational purposes only and not guaranteed accurate
-
You are solely responsible for how any AI-generated information is used
-
You must not rely on AI-generated content for financial, legal, or compliance decisions
Brumby Pay disclaims all liability associated with AI tool usage.
17. Copyright & Misuse
If you believe any content within the App infringes your intellectual property rights, please contact us at support@Brumbypay.com.au. Brumby Pay may investigate and remove any material found to violate third-party rights.
18. Service Availability
We do not guarantee continuous or error-free operation of the App. Access may be restricted at any time for maintenance, upgrades, or risk management.
19. Feedback and Suggestions
If you provide feedback or suggestions to Brumby Pay, you grant us a royalty-free, irrevocable licence to use that feedback to improve our services. You waive any claim to intellectual property created as a result.
